General Terms and Conditions of SEENBERG e.U., hereinafter referred to as Seenberg

By placing your order, you accept the following General Terms and Conditions.

General Provisions

The following conditions apply to all contracts, deliveries, and other services. Deviating provisions shall not apply; we expressly object to them. All side agreements require our written confirmation. The contract language is German.

Ordering

The product range offered in the Seenberg Online Shop constitutes an invitation to the customer to submit an offer to Seenberg e.U. (hereinafter Seenberg) to purchase under the conditions stated in the Seenberg Online Shop. All prices stated are in Euros and include statutory VAT but exclude shipping costs. You can find the shipping costs under Delivery and Shipping Costs – [link]. The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalogue. An order is only possible if all mandatory fields marked with * in the order form are completed. If information is missing or we are unable to fulfil the order for other reasons, the customer will receive an error message. Before finally submitting the order, the customer has the opportunity to correct it. Supporting detailed information is provided to the customer directly during the ordering process.

By clicking the "Send Order" button, you submit a binding order for the items in your shopping cart. Once the ordering process is complete, the customer will be notified via an info window: "Your order has been completed and successfully sent to us." The customer's order constitutes an offer. A contract is only concluded upon our acceptance. Confirmation of receipt of the order follows immediately after submission. We may accept your order by sending an order confirmation via email or by delivering the goods within five days. Seenberg reserves the right, in particular, not to accept the offer if an item is not available, if you have unjustifiably failed to pay invoices from previous deliveries, if your credit card check is unsuccessful, or if there are other justified doubts about your creditworthiness. If Seenberg cannot fulfil an order, we will inform you as quickly as possible. Orders are only accepted in household quantities.

Please note: The goods shown on the website have been digitally photographed. Minor deviations between the depiction of the goods and reality may occur; such deviations do not constitute a defect in the ordered goods.

We store your order data. If you wish to print your order, you have the option to print an "Order Confirmation." This appears on your screen after you have submitted the order by clicking the "Complete Order" button and your credit card details have been successfully verified. In addition, you will receive the order confirmation with all provided details by email, which can also be printed.

Delivery and Shipping Costs

Standard shipping within Austria costs €4.90 – to Germany €9.90. Delivery is free of shipping costs for orders from €100.00. For customers residing in all other EU countries, shipping costs €15.00. In this case, delivery is free of shipping costs for orders from €150.00. Shipping to Switzerland costs €19.90 and is charged for any order value.

Delivery is made via DPD, GLS, or Austrian Post AG. Delivery takes place within 2–4 working days plus postal transit time from the date of order. If delivered items show obvious material or manufacturing defects, including transport damage, please report such defects to us immediately. However, failure to make such a complaint has no consequences for your statutory claims.

Payment

You can pay for the goods either by immediate bank transfer (Sofortüberweisung) or by credit card. In the case of credit card payment, your account will be charged upon completion of the order.

If you default on payment, Seenberg is entitled to charge reminder fees as well as default interest at the legally permissible rate and, if applicable, additional processing costs.

Seenberg reserves the right to allow only certain payment methods in the event of a negative result from address and credit checks.

We accept the following credit cards: MasterCard, Visa, American Express

We use an SSL connection (Secure Socket Layer) for processing payments. After successful reservation of the invoice amount on your credit card account, we process your order within the delivery period.

Retention of Title

The goods remain the property of Seenberg until full payment has been received.

Right of Withdrawal (Right of Revocation)

For our customers who are consumers, the special provisions of the Austrian Consumer Protection Act (KSchG) apply. In particular, consumers are entitled under § 5e KSchG to withdraw from contracts concluded with us via our website within 14 days, unless one of the exceptions to the right of withdrawal under § 5f KSchG applies. The current version of the KSchG can be accessed at www.ris.gv.at. It is sufficient for the withdrawal declaration to be sent within the period. The withdrawal period begins for contracts for the delivery of goods on the day they are received by the consumer. In the event of withdrawal, full or partial reimbursement of the purchase price will be made in exchange for the return of the goods received by the buyer. If the goods are not returned unused and in a resaleable condition in their original packaging, we may demand compensation for their value.

In the event of an effective withdrawal, the services received by both parties must be returned, and any benefits derived (e.g. interest) must be surrendered. If you are unable to return the received service in whole or in part, or only in a deteriorated condition, you must provide compensation accordingly. This does not apply if the deterioration is solely due to inspection of the item – as would have been possible in a shop, for example. Otherwise, you can avoid the obligation to compensate for deterioration caused by normal use of the item by not using it as if it were your own property and refraining from anything that could impair its value. Obligations to refund payments must be fulfilled within 30 days. The period begins for you with the dispatch of your withdrawal declaration or the item, and for us with its receipt.

You can return your order within 14 days of receipt of the goods. This applies only to unworn and flawless jewellery pieces. ATTENTION! Please note that returns are only possible if the security seal has not been removed from the jewellery pieces!

Place the item(s) back in the SEENBERG jewellery box and into a shipping carton, and fill any gaps well. Please seal the carton securely.
